What is medpay and why is it good to have in a Richmond car accident?
Medpay is sometimes called medical expense benefits. It is optional insurance coverage on your own car insurance policy. Medpay covers your bills if you are in a car accident. It is nice to have and we recommend getting medpay if you can.
Sometimes your car insurance company refuses to pay your medpay claim. What do you do? If that happens to you take them to small claims court and sue them for bad faith. That makes them pay double plus they have to pay attorney fees.
Section A of the Code of Virginia 8.01-66 covers this situation. This only applies to claims of $3,500 or less.
You don’t need a lawyer to take your case to small claims court. The paperwork is easy for a layman to complete and the fees are about $50. Go to your local general district court and tell someone there that you have a claim for small claims court. They can help you find the proper place to go.
Here is another thing you should know. In Virginia, your medpay only has to pay the same amount on the bill that your health insurance paid. For example, suppose you have a $500 doctor bill that your health insurance only paid $100 for. In that example your medpay would only pay you $100 for that bill. Your insurance company will not send you a check for the total amount of medpay. You need to give them bills to prove the total.
