Pedestrians: Use the crosswalk!
Hi there this is Richmond, VA accident attorney Wayne O’Bryan.
When I am out driving in Richmond I always see pedestrians jaywalking. They seem to walk all over the street. I often see them crossing Broad Street in the middle of the road. Remember this: you are only legally protected from a car accident injury if you are in the crosswalk.
If you are not in the crosswalk and a car strikes you might get nothing for your injuries. This is because of the contributory negligence law in Virginia. This law states that if you are AT ALL at fault for an accident you are not entitled to any compensation from it. Even if the other guy is 99% at fault.
Pedestrians in the crosswalk are much easier to see. Drivers look for people in crosswalks. Drivers don’t expect to see pedestrians darting through the middle of the road.
Also please only cross when you have the proper signal that gives you the right of way. It is much safer for you and you have legal protection.
So please, for your own safety, always use the crosswalk if there is one available. It is the safest way to get to your destination. Getting hit by a car can ruin your day. You don’t want to end up at MCV with a broken leg or worse.
Please call me at 804-643-4343 if you have any questions about your accident claim. I have helped thousands of clients. I’m a nice guy who wants to make a difference in your life.
