Dion’s Story: A Child’s Bike Accident
Insurance Companies even pick on little kids!
Dion was an eight-year-old boy who was a passenger on a bicycle that was hit by a negligent and inattentive woman driving an ’87 Chevrolet in an area known to be inhabited by kids on bikes. The driver of the bike Dion was riding as a passenger on was killed by the collision.
Dion survived the impact but he was immediately taken by ambulance to the nearest trauma center with severe head trauma and damage to his arm. He received multiple stitches to his head and required a skin graft to his arm.
Dion’s injuries required him to seek treatment from a plastic surgeon for the severe damage to his arm.
Dion is a cute kid who has a marked stutter. He would not have made a great witness on his own behalf. We made a claim for Dion against the driver of the negligent vehicle’s insurance company.
They attempted to avoid their responsibility to Dion by pointing the finger at the dead boy on the bike and to attack Dion, the innocent victim. They said, “Dion should not have been riding on the bike and he contributed to his own injury.”
The insurance company refused to pay Dion a penny!
Well, we sued for Dion and made the insurance company answer to Dion in court. We conducted an investigation and found an eyewitness that heard the driver of the car admit her fault and we took depositions of all the witnesses and parties and we got the driver of the car to admit she was traveling faster than she should have.
We set the case for trial before a jury and just days before we were ready to go to trial, the insurance company paid Dion a fair settlement.
