Dog Bites: The One Bite Rule
In this video, Wayne O’Bryan describes the laws surrounding dog bite cases. Every dog is entitled to one bite. This allows the dog’s owner to learn that his or her dog is dangerous and take appropriate precautions. After that first bite, however, legal action can be taken against the owner. In more recent years, the law has been extended to cover cases where the owner knows he or she has a dangerous dog from sources besides the first bite.

“The rule of thumb in dog bite cases is every dog is entitled to one bite. That goes back thousands of years. The reason for that rule is that the owner of the dog is on notice that he has a dangerous dog on his hands. One of the ways that he could learn that he has a dangerous dog is if the dog gets its first bite, but after that first bite the owner is on notice. That rule has been somewhat modified. The owner can be aware of dangerous proclivities of the dog from other sources other than the first bite.”
